Testamentary Capacity Assessment

Making sure your decisions regarding your Will are sound and just, this includes making, changing or revoking a Will.


Testamentary Capacity Assessments are different from other areas of Mental Capacity and is based on case law (Banks V Goodfellow 1870) rather than the Mental Capacity Act (2005).


It helps to support your choices and reduce the chances of contest once you have died.  Most importantly it shows that you fully understand and appreciate the choices you are making.


Why Assess?

If there is any doubt about anyone's ability to make complex decisions, or there is a large estate, or there may be an amendment regarding family or a seemingly unwise choice in the Will, then an assessment is recommended.
