What is Mental Capacity?

Mental Capacity is the ability to make specific decisions at specific time points,     


(Mental Capacity Act 2005).


This means that a decision can be about something simple, such as deciding if you should wear a raincoat in wet weather - or - it can be making a more complex decision like accepting treatment for a health condition or making decisions about financial or property matters. 


Everyone is assumed to have it until proven otherwise.

You cannot assume someone does not have capacity until they have been assessed for a specific decision.
